To install the mod...was there any licensing agreement you had to accept?
If yes, was there anything in it that would allow the modder to behave like you described?
If not, i would say he can not forbid you to host a server with this mod.
But maybe the mod includes a car that the manufacturer in real life forbid to use in games, then the facts would change.
I remember the BMW Z4 was such a car.

Yeah, unless there are legal thingy's that can be solved via lawyers you are entering the realm of gentlemanly agreements and Interweb Intellectual Property. which is at the mercy of the user.
